These Terms are primarily intended for clients purchasing our services for business, trade or professional purposes.

Our Services

Munata Creative provides digital services which may include:

website design and development;

website maintenance and support;

CRM setup and automation;

Google Business Profile services;

digital growth services;

AI-powered automation;

social media strategy; and

other related services agreed with the client.

The exact services, deliverables, prices and any ongoing fees will be set out in the quotation or proposal provided to the client.

Quotations and Acceptance

Before work begins, we will normally provide a quotation identifying one or more proposed services.

The client may confirm which services they wish to proceed with verbally or in writing.

Once the selected services have been agreed, Munata Creative will issue the appropriate invoice and/or Stripe payment link reflecting the agreed services.

Payment constitutes confirmation that the client wishes us to proceed with the selected services and accepts the applicable quotation and these Terms & Conditions.

Payment and Commencement of Work

Unless otherwise agreed in writing, work will begin only after the required initial payment has been received.

Work may commence from the date payment is received in full for the relevant initial invoice.

Any ongoing or recurring fees will be charged according to the agreed service arrangement.

Client Cancellations

For business clients, unless different cancellation terms are stated in an agreed quotation:

Within 3 days of payment
The client may cancel and receive a refund of the amount paid, less a £50 administration charge.

From day 4 up to and including day 7 after payment
A cancellation will result in an administration/cancellation charge of £500 or 50% of the amount paid, whichever is lower. The remaining balance will be refunded.

After 7 days
Payments are non-refundable unless otherwise agreed by Munata Creative or required by law.

These provisions reflect the allocation of project time, planning, setup and resources that may begin as soon as payment is received.

Nothing in these Terms removes any statutory rights that cannot legally be excluded.

Client Responsibilities

Clients are responsible for:

providing accurate business information;

providing requested materials and approvals within a reasonable timeframe;

ensuring they have permission to provide and use any text, photographs, logos or other content supplied to Munata Creative;

reviewing information, claims and business details before publication;

notifying us promptly of required corrections; and

complying with laws and regulations specific to their own industry or business.

Delays in receiving content, feedback or approvals may affect agreed completion dates.

Revisions and Scope

Work will be carried out according to the agreed quotation or project scope.

Any revisions included within the service will be handled according to the agreed project arrangements.

Requests substantially outside the agreed scope may be treated as additional work and may require a revised quotation or additional charge before being carried out.

Content and Intellectual Property

Content supplied by the client remains the property of the client or its respective rights holder.

The client confirms that it has the necessary rights or permissions to use any material it supplies to Munata Creative.

Original images, graphics or visual content created by Munata Creative remain the intellectual property of Munata Creative unless ownership is expressly transferred in writing.

Where Munata Creative-created material is incorporated into an agreed client project, the client is permitted to use that material as part of the delivered project unless otherwise stated.

Third-party assets, software, fonts, plugins, stock materials or platforms remain subject to their respective licences and terms.

Domains

Where a domain is purchased or registered for a client, ownership of that domain will belong to the client, subject to the relevant domain registrar's terms.

Unless Munata Creative has specifically agreed to manage the domain, responsibility for renewing the domain and associated subscriptions rests with the client.

Where a domain has been purchased or managed through Munata Creative, we will make reasonable efforts to notify the client of relevant renewal dates.

Munata Creative cannot guarantee continued domain availability where renewal payments are not made when due.

Hosting and Ongoing Services

Some services may include website hosting, maintenance, support or other recurring services.

If a client stops paying an agreed monthly charge, associated monthly maintenance or ongoing services may be withdrawn after 30 days.

Where applicable, Munata Creative may continue to host the website until the relevant domain expires, unless another arrangement is agreed or circumstances require earlier suspension.

The client remains responsible for domain renewals and any third-party services registered directly in their name.

Third-Party Services

Projects may rely on third-party systems including hosting providers, domain registrars, payment platforms, CRM providers, Google services and other software.

Munata Creative is not responsible for interruptions, changes, restrictions, outages or failures caused by third-party providers outside our reasonable control.

Any third-party charges not expressly included in our quotation remain the responsibility of the client.

Website Performance and Results

We aim to create professional digital solutions designed to support the client's business goals.

However, Munata Creative cannot guarantee:

specific search-engine rankings;

a particular volume of enquiries, leads or sales;

Google Business Profile positions;

advertising performance;

uninterrupted availability of third-party services; or

specific commercial results.

Results can depend on numerous factors outside our control, including competition, market conditions, client activity and third-party platforms.

Limitation of Liability

Munata Creative will provide its services with reasonable care and skill.

To the extent permitted by law, we will not be responsible for indirect or consequential losses arising from matters outside the agreed scope of our services or circumstances beyond our reasonable control.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud or fraudulent misrepresentation or death or personal injury caused by negligence.

Ending Ongoing Services

Either party may request cancellation of an ongoing service in accordance with any notice period or cancellation arrangement agreed in the relevant quotation or service agreement.

Any outstanding amounts for services already supplied remain payable.

Changes To These Terms

We may update these Terms & Conditions from time to time.

Changes will not retrospectively alter an existing agreed project unless both parties agree or the change is required by law.

Governing Law

These Terms are governed by the laws of England and Wales.

Any dispute will be subject to the jurisdiction of the courts of England and Wales, except where applicable law provides otherwise.
